North Dakota No Fault Auto Insurance
North Dakota is one of twelve US states that use no fault auto insurance rather than traditional or tort insurance. Unlike traditional insurance, no fault insurance providers pay out whether or not the policy holder is at fault. The state of North Dakota has chosen no fault insurance for the same reason every other state has, less litigation. By removing the courts job of deciding fault payments can be expedited and court cases are less.
Auto insurance companies licensed in North Dakota will automatically report your no fault car insurance coverage to the North Dakota Department of Motor Vehicles (DMV). North Dakota insurance companies must also report cancelled or dropped no fault auto insurance to the DMV to ensure that all cars in the state are in compliance with the law.
No fault insurance also limits when you can sue another driver. In North Dakota medical bills must amount to $2,500 before litigation becomes an option. This minimum is to prevent claims for minor injuries, but allow drivers to seek further restitution in the event of serious damage. In some states serious damage is not a monetary amount, but a verbal amount.
North Dakota no fault insurance law requires policy holders to have coverage amounting to a minimum of $30,000 in personal injury protection, $50,000 in bodily injury liability, $25,000 in property damage liability, and $50,000 in uninsured motorist coverage. All of these are standard for no fault insurance policies, but the amounts required by each state differs.
